Facing a criminal allegation can be stressful, especially when you are unsure about your legal rights and next steps. Having an experienced solicitor can help you understand the legal process and prepare an appropriate defence. Advice Wise Solicitors provides criminal defence services, helping individuals navigate legal challenges with professional guidance and representation.

Worth adding some practical points to this, because it reads a bit like an advert and the thread title deserves more substance.

Why it matters for business owners specifically
Criminal allegations against company directors tend to look different from the cases most high street firms handle. Think HMRC investigations, fraud or money laundering accusations, health and safety prosecutions after a workplace incident, or regulatory breaches that carry criminal penalties. A general criminal solicitor who mostly does motoring offences and assault cases may not be the right fit for a Companies Act or VAT fraud matter. Ask directly how many cases of that type they have run in the last couple of years.

Checks before instructing anyone
  • In England and Wales, confirm they are regulated by the Solicitors Regulation Authority. Scotland has the Law Society of Scotland, and Northern Ireland has its own Law Society. The registers are searchable and free.
  • Look for Law Society accreditation in criminal litigation, or membership of a specialist body for fraud and business crime.
  • Get a written fee estimate. Private criminal work can run into tens of thousands for a Crown Court trial, so clarity on hourly rates versus fixed fees is essential.
  • Ask who will actually handle the case day to day. Some firms put a senior name on the website and a trainee on the file.

Two things people often miss
Free legal advice at the police station is available to everyone in England and Wales, regardless of income, so never agree to an interview under caution without a solicitor present. That applies to HMRC and other investigator interviews too, not just the police. Second, keep your business insurer in the loop early. Directors and officers cover, or legal expenses cover bolted onto a commercial policy, may fund representation if the claim is notified promptly.

Choosing well at the start saves money and stress later. Switching solicitors halfway through a case is possible but messy, and a weak police station interview can undermine a defence before it has properly begun.
