Who the 2022 Act targets The Skills and Post-16 Education Act 2022 does not create an offence for the student. The criminal liability sits with the
provider. It is an offence in England to provide, arrange, or advertise a service that completes all or part of an assignment on behalf of a student where the student could then present it as their own. Penalties are an unlimited fine on conviction. Scotland, Wales and Northern Ireland handle this differently, so anyone trading UK-wide needs to check each jurisdiction rather than assume one rule covers everything.
For the student, the consequences remain contractual and regulatory: the university's own misconduct procedures, which can range from a capped mark to expulsion. That is a serious outcome, but it is not a criminal record.
The "model answer" problem for businesses This is where a lot of tutoring and study-support companies get into difficulty. Labelling something a "model answer", "reference only" or adding a disclaimer stating it must not be submitted does
not provide protection under the Act. The test is whether the material is written to answer the student's specific assignment and could reasonably be submitted. A generic worked example in a published revision guide is very different from a bespoke 2,000-word response to a live coursework brief.
Anyone operating a Ltd company or sole trader business in this space should be looking at:
- Whether marketing copy implies the work can be handed in. Advertising alone is an offence.
- Whether payment terms, turnaround times and word counts match assignment deadlines, which regulators treat as evidence of intent.
- Directors' personal exposure, since the Act allows officers of a company to be prosecuted alongside the company itself.
- Merchant account and payment processor terms, as several have already dropped essay mill clients regardless of the legal position.
