This silly couple are suing McDonalds because nude photo's left on their phone (which they accidentally left in a McDonalds restaurant (A restaurant...yeah right)) got onto the internet along with the couple name and address.

The restuarant said the phone would be held securely after they came back.

But it's so easy to see how McDonalds could be exploited here. A couple offers a McDonald employee a share of any claim they make for them "accidentally leaving" their phone in one of their establishment.

Simple rule of thumbs.

If your lucky enough to let your other half take such photo's don't use your mobile phone which could easily be lost, stolen or left behind somewhere!! Pillocks!!

The same could be said for any personal details you may leave on a phone, bank account details, addresses, pictures of your kids.

Where does personal responsibility end and corporate ownership take over in this case....

Nah....I go with McDonalds on this one.

It reeks of scam quite frankly and I hope the couple are brought to book.

There are any number of ways in which data can be pulled off a mobile phone. We haven't heard the whole story or even a fraction of it. But aside from actually ensuring the phone isn't physically stolen again once recovered, I can't see how anyone can be held responsible for data security on a device they have merely taken into protective custody...

I despise MacDonalds and the way they do business. But yeah, I hope this goes in their favour.

Thanks...I agree

The couple don't have a leg to stand on....there is no idea how long between the couple leaving the restaurant and someone else sitting down at the table before it was cleared....any smart lawyer would argue that. Someone may have downloaded the information then handed it to the McDonalds staff.

What if it had been a wallet and the couple said, that it had a pile of cash in it. No this case comes down to taking responsibility. You run the risk of this happening if you put things on a easily poratble device.

One could easily argue as well....most mobile devices come with at least some minor security, they I suspect hadn't even applied that. What if you had not locked your car and it was stolen...do you then blame the car park company it was in? No you don't you apply some basic common sense.

This couple are trying to get millions because they lack common sense...or as you say Matt....they are up to a scam.

And yes, I don't like McDonald business practices either.
